This Booking is made subject to the following Terms and Conditions:

1.0 Agent

Staying Cool (“the Company/we”) is acting as booking agent on behalf of Paul Taylor and Colin Malcomson trading as Soller Townhouse (“Owners”) and the booking contract shall be between you and the Owners.

2.0 Minimum Age

Bookings cannot be accepted from anyone under the age of 21. We reserve the right to refuse a booking to anyone or to any group.

3.0 Payment

3.1 A non-refundable deposit of 25% of the total cost of your holiday is required to confirm your booking. Your booking will not be guaranteed until payment of the deposit is received.  Upon confirmation by you of the booking, we shall provisionally hold the agreed dates for a maximum period of 7 days until receipt of the deposit. If the deposit is not received within the 7 days we will release the dates.

3.2 In addition to the total cost of your holiday, you shall also pay to us a security deposit, as set out in your booking confirmation. The security deposit shall be paid at the same time as the balance the cost of your holiday. The security deposit shall be retained until after your departure when we will carry out a property inspection. If the property is not left in a reasonable state, we will use some or all of your security deposit to cover the costs of cleaning, repair and/or replacements. Otherwise, we will return your security deposit to you within 14 days of the end of your holiday. Payment of the security deposit and/or retention of it by us shall not in any way limit your liability to us with regard to any damage to the house or its contents.

3.3 Payment of the balance, together with the security deposit, is required no later than 10 weeks prior to your arrival date. We will endeavour to contact you to remind you of payment but responsibility to pay the balance by that date is yours and so you must ensure that the final balance is paid in good time. If your booking is made less than 6 weeks before your arrival date, full payment will be due immediately.

3.4 If we have not received payment of the balance, and the security deposit, within 6 weeks of your arrival date, we shall have the right to cancel your booking and the house and dates may be re-advertised. In such circumstances your deposit will be retained.

3.5 If payment is made by BACs transfer to the nominated bank account, either in Pounds Sterling or Euros, payment will not be regarded as having been received until funds have been cleared in the account.

4.0 Cancellation

4.1 Cancellation by you – The deposit is non-refundable. If you cancel your booking between payment of the deposit and the date when the balance is due, your deposit will be retained. Once the balance has been paid, the total cost of your holiday is non-refundable in the event of cancellation.

4.2 Cancellation by us/Owners – we reserve the right to cancel your booking in the event of circumstances beyond our/Owners’ reasonable control. In the unlikely event of that happening, we will:

5.0 Holiday price

5.1 The total price of your holiday includes the use of the accommodation for the maximum number of guests (8) and includes the provision of bed linen and towels and use of the utilities, contents and appliances. The total cost of your holiday will be shown on your booking confirmation. If you book a holiday of more than one week’s duration, the total cost of your holiday will include a weekly cleaning service, which will include change and replacement of bed-linen and towels. If you require a more frequent bed-linen and towel service, this must be agreed on booking and will be charged as an extra.

5.2 The total cost of your holiday does not include additional services or activities e.g. cycle hire, beauty treatments, meals.  Additional charges and different booking arrangements will apply to any such services, which are agreed.

6.0 Arrival and departure

The house will be available to you from 16.00 on the day of your arrival. You must vacate the house by 10.00 at the latest on the day of your departure and leave the keys in the master-key safe lock. Left luggage and late departures are strictly by prior arrangement and may incur an additional charge.

7.0 Property maintenance and house rules

7.1 You agree to keep the property and all furniture (interior and exterior), fixtures, fittings and effects in or on the property in the same state of general order and repair as at the date of your arrival. You agree to leave the property in a reasonable state of cleanliness. You must report to us any damage or breakages, which occur during your holiday and we reserve the right to charge you for these. Following your departure we will inspect the property and will make deductions from your security deposit if the property is not left in a reaonable state.

7.2  The house is a no-smoking house, and smoking shall only be permitted in the garden.

7.3  No pets or other animals are allowed to enter or stay in the house.

7.4 You shall not undertake any filming or photography in the house for your personal or business’ financial gain without our prior agreement.

7.5 Please be aware that the house is a quiet residential area with neighbours close by. You should at all times have respect for other residents in the vicinity of the house and shall not cause or allow to occur any unreasonable noise or other nuisance, in particular loud music in the garden.

7.6 If you or any of your party breaches any of these terms and conditions, we may at our absolute discretion require you to either remedy such breach or to vacate the house immediately. Such right shall be without prejudice to any other rights or obligations set out in these terms and conditions.

7.7 At any times during your stay we or the property manager shall be entitled to or may permit others to enter the house in order to carry out necessary repairs or in order to reasonably assess or prevent any breaches of these terms and conditions. We will at all times try to give prior warning.   

8.0 General

8.1 Your personal belongings and effects are your responsibility during your holiday. No liability is accepted for any accident, loss or damage to your property during your stay.

8.2 You should take usual care and attention when staying at the house, which is an old house, and should take whatever steps as reasonable to look after the safety of your group, including any children, particularly having regard to the stairs, which are steep, and the garden. No responsibility or liability is accepted for personal injury to you or any member of your party or your invitees, unless caused by the Owners’ negligence.

8.3 If you have problems or complaints, please bring these immediately to the attention of the Property Manager who will try to resolve the problem directly with you. If the Owners are unable to resolve the problem during the course of your holiday and you remain dissatisfied, please contact us on your return setting out full details of the problem and your complaint. We will investigate and endeavour to resolve the situation with the Owner to your and the Owners’ satisfaction. Please note, any problem or complaint which is submitted for the first time after your holiday and without having being raised during your holiday is likely to be more difficult to resolve.

8.4 These terms and conditions shall be shall be governed by English law and the parties agree to the exclusive jurisdiction of the Courts of England and Wales
